Terms of Service

1. Agreement and eligibility

You must be at least 18 years old and legally capable of entering a binding agreement. If you register for a company or another organisation, you represent that you are authorised to bind it. Information supplied during registration must be complete, current and accurate.

2. Account registration and security

Each business is responsible for its administrators, staff accounts, passwords and activities performed through those accounts. Credentials must not be shared outside authorised staff. You must notify the operator promptly if an account, device or password may have been compromised. The operator may require identity or business verification before restoring access or changing ownership.

3. Service licence and acceptable use

The operator grants the registered business a limited, non-exclusive, non-transferable and revocable right to use DukaFlow for lawful internal business operations during an active account. You must not attack, probe, overload, reverse engineer, resell, copy or use the service to transmit malware, infringe rights, commit fraud, evade taxes or violate applicable law.

4. Business records and customer data

The business controls the sales, product, employee, customer and supplier information it enters. It is responsible for having a lawful basis and providing any notices required when collecting personal information. DukaFlow is an operational tool and does not replace professional accounting, tax, legal or regulatory advice. The business must review reports and correct inaccurate entries.

5. Subscriptions and payments

Subscription charges, duration and applicable plan are communicated separately. Online payment processing is not currently enabled. Payments are recorded manually by the super administrator. Expiry or non-payment does not automatically block an account; only an authorised super administrator may block or restore access. Fees already earned are non-refundable except where required by law or expressly agreed in writing.

6. Suspension and termination

Access may be restricted for security threats, unlawful activity, serious breach, fraudulent use or at the business owner’s request. Where practical, notice and an opportunity to remedy will be provided. A business should export or request its records before termination. Retention or deletion following termination is governed by the Privacy Policy and applicable legal obligations.

7. Availability, maintenance and changes

The operator aims to provide a reliable service but does not promise uninterrupted or error-free availability. Planned maintenance, emergency repairs, internet failures, hosting failures and events outside reasonable control may affect access. Features may be improved, replaced or discontinued with reasonable notice where a change materially affects normal business use.

8. Backups and business continuity

The operator may maintain system backups, but the business remains responsible for periodically exporting essential records and maintaining procedures for operating during an outage. Backups are designed for disaster recovery and may not permit restoration of an individual transaction.

9. Third-party services

Hosting, email, telecommunications or other third-party services may support DukaFlow. Their availability and separate terms may affect particular functions. No mobile-money or card credentials should be entered unless a formally supported payment integration is introduced and clearly identified.

10. Intellectual property

DukaFlow software, design, branding and documentation remain the property of the operator or its licensors. The business retains ownership of its business data. Feedback may be used to improve the service without identifying the person who submitted it.

11. Disclaimers and limitation

To the extent permitted by Tanzanian law, the service is supplied on an “as available” basis. The operator is not liable for indirect, incidental or consequential loss, lost profits, or loss caused by inaccurate entries, unauthorised credential sharing, unsupported integrations or failure to keep independent records. Nothing excludes liability that cannot lawfully be excluded.

12. Indemnity

The business is responsible for claims and reasonable costs arising from its unlawful content, misuse of the service, violation of another person’s rights or breach of these Terms, except to the extent caused by the operator’s own unlawful conduct.

13. Governing law and disputes

These Terms are governed by the laws of the United Republic of Tanzania. The parties should first attempt good-faith resolution through written notice. If unresolved, a dispute may be submitted to a court or other competent forum in Tanzania, subject to any mandatory consumer or statutory rights.

14. Changes to these Terms

Material changes will be displayed in the service or communicated using registered contact details. The effective date and version will be updated. Where required, renewed consent will be requested. Continued use after lawful notice means acceptance of the revised Terms.
